AlbumFrog Terms & Conditions of Use

1. Acceptance of Orders
   
   a) All orders are accepted and handled in accordance with the conditions below.
   
   b) The customer accepts these conditions by using the AlbumFrog specified software platform and website. We use third party software to upload your order to us. In order to download the software you must agree to abide by the terms and conditions of that software.
2. Copyright Provisions
   
   a) AlbumFrog is not liable for any images or materials submitted to the website for printing. The client [you] are solely responsible for all copyright issues relating to your order.
   
   b) AlbumFrog does not accept responsibility for the contents of the file you submit.
   
   c) By ordering from AlbumFrog, you are solely responsible for any unauthorised use of images or copyright material. AlbumFrog will not and cannot verify the origin of any material submitted for printing, and the submission of your order implies that you will observe and be solely liable for all copyright, trademark, privacy and other image and copyright licensing laws, or other applicable laws of Australia and or the country[s] in which you will be distributing the final printed product.
   
3. Liability is Limited
   
   a) AlbumFrog Pty Ltd will not accept responsibility for the quality of any images submitted. AlbumFrog makes clear that the quality of the prints bound in the albums ordered will not be better than the computer screen quality of the images.
   
   b) You are solely responsible for the proofing and verification of the images and text in your order. AlbumFrog’s liability will only extend and be limited to production and shipping of the product, not the lack of image resolution, inaccurate text, incorrect mailing address or other errors submitted by you.
   
   c) We print orders as they are - Meaning, we will process the order according to how it was received and will make no adjustments to the order so please make sure you use the quality indicator when preparing your order to ensure your image quality is suitable for your order
   
4. Delivery time
   
   a) All orders are depatched within 7 working days and are sent by Australia Post our nominated carrier. If for what ever reason delivery will be delayed we will contact you, however a delay in delivery will not accepted as a reason for an order cancellation or request for any form of compensation.
5. Guarantee
   
   a) Any complaints must be submitted within 7 days of the delivery of the materials ordered by you to service@albumfrog.com.au.
   
   b) If the complaint is justified, AlbumFrog’s liability is limited to resupplying the ordered materials again.
6. Use of the Website is at Your own risk
   
   Subject to these terms, You assume full responsibility and risk of loss resulting from Your downloading of software, use of, or access to data, files, information, Content, or other material on or through the Website.
   TO THE EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES WILL ALBUMFROG BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING (BUT NOT LIMITED TO) LOSS OF PROFITS, LOSS OF OR DAMAGE TO GOODWILL OR OTHER EXPECTATION BENEFIT OR LIABILITY TO ANY THIRD PARTY, THAT ARE DIRECTLY OR INDIRECTLY RELATED TO THE USE OF, OR THE INABILITY TO USE, THE WEBSITE OR ANY CONTENT PROVIDED ON IT OR THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR THAT SUCH DAMAGES WERE FORESEEABLE.
7. Disputes
   
   Where a dispute arises, the laws of the State of Victoria will govern the legal relationship between the parties. The customer agrees that the forum of choice will be that of the State of Victoria
